This website is owned and operated by Just Pictures, based at 11 Philip Court, 74a The Drive, Hove, East Sussex, BN3 3EY.

You agree that email and other electronic communications can be used as a means of communication for the delivery of acknowledgements, estimates, contracts, notices, invoices and any other information in pursuance of delivering services to you.

5. Eligibility to purchase services from us

For you to be eligible to purchase services on this website and lawfully enter into and form a contract with us, you must:

• be legally able to enter into a contract

• Provide sufficient details for a service to be delivered, such as your name, an email address and or a postal address in order for packages to be sent to you should that be a part of the service to be delivered

6. Price

​

Prices for a number of services shown on this website are provided as initial guidance only to help give you an idea of approximate costs although in some cases the guidance price for a service, which may have a fixed or relatively fixed pricing structure, will be accurate or reasonably so, such as for scanning services.  Many jobs, depending on a number of factors such as complexity or additional enhancement requests to the standard service will determine the price.  Once we can establish your exact requirements we can provide you with an accurate price for that job.

  

7. Payment

Payment are to be made on receipt of a Just Pictures invoice, instructions and payment options will be included on the invoice.

We will confirm payments have been successfully made before the dispatch of your order.  

​

By accepting these Conditions you:

​

• confirm that all details you provide to us for the purchase of services are accurate and lawful

​

• confirm that we can contact you should any issues arise

​

We do not offer credit, ensure you have funds available to complete the order before asking us to undertake any work.  If you are unable to pay at the appropriate time you must make contact, storage charges may apply. 

  

We take all reasonable care, to ensure details of your order and payment remain completely secure, but outside of negligence on our part, we will accept no liability for any loss you may suffer if a third party obtains unauthorised access to any data that you provided when accessing our website.

8. Orders and formation of a contract

​

All orders are subject to acceptance and availability. If any services are unavailable, you will be notified by email and you will have the option either to wait until that service can be delivered or to cancel.

Orders placed by you constitutes an offer to purchase services from us.  All offers received from you are subject to acceptance by us.

We reserve the right to refuse any order placed by you at any time prior to us undertaking the work, without the need to provide an explanation.

You are responsible for the details you provide when ordering services.  We will not accept any responsibility for any loss you incur because the details you provided were inaccurate.

The Contract will relate only to the services that have been agreed.  We will not be obliged to supply any other service which was not part of your original order without forming a new contract.

You will be subject to the terms and conditions shown on this website at the time you ordered the services from us, except where:

​

• changes are required to those terms and conditions due to a change in the law

9. Delivery

​

Completed orders will be delivered to you at the email address or property address, should this be a parcel, which may be an address different to the billing address, that you provided when contracting the service, the responsibility is on you to ensure accuracy of these details as we accept no responsibility for any loss because we were provided with inaccurate information.

​

All items restored, colourised, or retouched and delivered to you electronically will be first sent to you as a proof at a lower resolution which may also contain Just Pictures watermarking for your acceptance, before a suitable, high resolution, non-watermarked image(s) will be provided. 

​

We use professional carriers to deliver any order that requires use of the postal system.  Please inspect your order on arrival for any obvious damage before signing for it.  It will always leave us in a sound condition.

​

Any dates quoted by us for postal delivery to you after the work has been completed are approximate, but will be in line with what the selected carrier states their delivery times to be.

​

We will not be liable for any delay in delivery of the goods once it has been passed to the carrier.

​

For work being undertaken at busier times of the year, such as the Christmas period we cannot guarantee deliveries by 24th December.

​

If for any reason you wish to defer delivery of postal items we reserve the right to charge for storage.

​

10. Risk and ownership

​

The responsibility for goods will be at your own risk once the delivery is completed.

​

Ownership of the completed works will only pass to you once we have received full payment including delivery fees.

​

11. Complaints

​

If you have a comment, concern or complaint about the service you have received, please contact us via the contact link on the website menu.

12. Intellectual Property

​

The content of the website is protected by copyright which includes, but is not limited to, the design, trade marks, text, software, photographs, where we are the copyright owner, and graphics.

 

You are permitted to download or copy items displayed on the website subject to the condition that the material may only be used for ‘personal, non-commercial purposes’ with the exception of some original images, where indicated, that are under a creative commons license.  For these please credit them accordingly or preferably visit the original source to access that image and satisfy yourself that it is suitable for your usage.

You are permitted to retrieve and display the content of the website on a computer screen, store the content in electronic form on a hard disk or print a copy of the content for your own ‘personal, non-commercial use’, provided you keep intact all and any copyright and any other notices.  You may not otherwise reproduce, modify, copy, distribute or use any of the materials or content on the website.  Some images on this website, as highlighted above may be subject to a creative commons license, this does not necessarily mean it will be suitable for your requirements, as a consequence you may be better served by visiting the original image source.

By submitting images to us, in any format, for restoration, colourisation, retouching or scanning services you are confirming that no copyright infringement will occur as a result of us undertaking the work.  Just Pictures will not be liable to you or any other party for any such infringement. liability will entirely rest with you, as the onus is upon you to establish the copyright status of any image that you are not the author of and whether, if copyright does exist, what permitted use, if any, might be available and to clearly set out those conditions if you intend submitting that media to Just Pictures.

15 Force majeure

We have no liability for delays or failures in delivery or performance of our obligations to you resulting from any act, events, omissions, failures or accidents that are outside of our control such as strikes, telecommunications, computer or network failures, civil unrest, epidemic or other natural disaster or government restrictions.

Our ability to deliver on a contract will be deemed to be suspended for the period that the event of Force Majeure continues,  We will use reasonable endeavours to minimise any delay caused or to find a solution by which our obligations may be met despite the event in question.  We shall notify you of the likely duration of any delay.

Where the delay in relation to any event exceeds 30 days, either you or us may, by written notice to the other, terminate the contract with immediate effect.
